Terms of Service
The agreement between you and The Coaching Nexus. Last updated 20 May 2026.
1. Agreement
These terms (“Terms”) form a binding agreement between you and The Coaching Nexus, operated as a sole-trader business by Robert Gregory in South Australia, Australia. By accessing this website, the member portal, or purchasing any product or service, you accept these Terms.
If you do not accept these Terms, do not use the website, portal, or any service. We may update these Terms from time to time. The current version is always available at this URL.
2. What we provide
The Coaching Nexus provides:
- Psychological profiling instruments (CVMP, FVMP, NVMP, BVMP, HVMP, PMP-Frontline and their derivatives) for athletes and professionals operating under performance pressure;
- A member portal where you can complete those assessments, review your results, set development goals, and access related resources;
- Coaching debriefs, delivered by Rob Gregory, via video meeting or in person;
- Programs, workshops, and bespoke engagements delivered to teams, clubs, schools, and organisations on a contract basis.
What we are not. The Coaching Nexus is a performance-coaching service. We are not a registered psychology practice, a clinical service, a counselling service, or a mental-health treatment provider. Our profiling instruments do not produce a clinical diagnosis. If you are in distress, in crisis, or believe you may be experiencing a mental-health condition, you should contact a registered clinical professional. In Australia, you can reach Lifeline on 13 11 14, Beyond Blue on 1300 22 4636, or your GP for a mental-health treatment plan referral.
3. Eligibility
To purchase a product or create an account you must:
- Be at least 18 years of age, or be using the service under the supervision and consent of a parent, guardian, or recognised coaching practitioner;
- Provide accurate and current information;
- Have the legal capacity to enter into a binding contract under Australian law.
Pathway-tier products (designed for athletes aged 13–18) may only be assigned by a recognised practitioner working with appropriate consent from the young person and their parent or guardian.
4. Your account
You are responsible for keeping your password confidential and for all activity on your account. You must let us know promptly at rg@thecoachingnexus.com.au if you believe your account has been accessed without your authorisation.
We may suspend or terminate any account that we reasonably believe has been used in breach of these Terms, for fraudulent or unlawful purposes, or in a way that risks the integrity of our profiling instruments.
5. Purchases, payments, and refunds
Payments
Self-serve purchases (profiles, debriefs, profile bundles) are processed by Stripe in Australian dollars. Card details are entered directly into Stripe's secure checkout and are not transmitted to or stored by The Coaching Nexus.
Practitioner-arranged or invoiced purchases are billed under separate written agreement.
Refund policy
- Self-serve assessments (Profile tier). Once you have started an assessment, the product is considered consumed. We do not offer refunds for completed or partially-completed assessments. If you purchased by mistake and have not started the assessment, contact us within 7 days for a refund.
- Debrief sessions. Full refund or reschedule available if cancelled more than 48 hours before the scheduled time. Cancellations within 48 hours are refunded at our discretion and may be subject to a A$50 administrative deduction.
- Bundled products (Profile + Debrief). If you completed the assessment but have not attended the debrief, a partial refund equal to the debrief tier is available within 30 days of purchase.
- Faulty or unfit for purpose. Nothing in this section limits your rights under the Australian Consumer Law. If a product or service is faulty, materially different from what was described, or unfit for its purpose, you are entitled to a remedy.
6. Intellectual property
All content, software, branding, profiling instruments, dimension architecture, item banks, scoring methodologies, narrative outputs, sample reports, marketing materials, and documentation on this website and in the member portal are the intellectual property of The Coaching Nexus and Robert Gregory. They are protected by Australian and international copyright, trade mark, and trade secret law.
When you purchase or are assigned a profile, you are granted a personal, non-transferable, non-exclusive licence to view, save, and use your own results for your own coaching and development purposes. You are not granted any rights to:
- Reproduce, copy, scrape, redistribute, sublicense, or sell any part of the profiling instrument, the item bank, the scoring logic, the narrative outputs, or the sample reports;
- Use the instrument or its outputs to train, evaluate, fine-tune, or benchmark any artificial intelligence model, language model, or similar system;
- Build a competing profiling, coaching, or assessment product based on observation of the instrument or its outputs;
- Use The Coaching Nexus branding, instrument names, or methodology in any external publication, presentation, or commercial product without prior written permission;
- Allow any third party access to your account, your results, or the portal in a way that effectively transfers the licence.
Your own report is yours. The above restrictions cover the instrument, not the individual narrative we produce about you. You can share your own report with a coach, family member, employer, or anyone else of your choosing. Where you share it, you remain responsible for what happens to it after.
Reverse engineering and item-bank protection
You agree not to attempt to derive, decompile, or reverse engineer the item bank, the scoring logic, the dimension structure, or the response credibility detection. Attempts to identify the “correct” answer pattern, or to share that information for the purpose of gaming the instrument, undermine the integrity of the tool for everyone and may result in account termination without refund.
7. Your responsibilities when using the instruments
To get a useful read from any of our instruments, you agree to:
- Answer honestly to the best of your ability;
- Complete assessments without external assistance or coaching on individual items;
- Recognise that the instrument is most useful when used in conjunction with a coaching conversation, not in isolation;
- Not use the instrument to make selection, employment, medical, or legal decisions about other people without our written agreement.
8. Privacy
How we collect, use, and protect your personal information is set out in detail in our Privacy Policy, which forms part of these Terms.
9. Service availability
We aim to make the portal available 24 hours a day, 7 days a week. From time to time we may need to take the service offline for maintenance, upgrades, or to respond to security incidents. We will give reasonable notice of planned downtime where we can. We do not offer a contractual uptime guarantee on self-serve products. Bespoke contracts may include specific service levels.
10. Limitation of liability
To the maximum extent permitted by Australian law:
- The Coaching Nexus, Robert Gregory, and any associated providers will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of the service;
- Our total aggregate liability to you under or in connection with these Terms is limited to the amount you have paid us in the 12 months preceding the event giving rise to the liability;
- Nothing in these Terms limits any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded.
11. Outputs are coaching, not clinical advice
The profiling outputs, AI-generated summaries, coaching reports, debriefs, and any other narrative content produced by The Coaching Nexus are coaching observations and conversation tools. They are not:
- A clinical or psychological diagnosis;
- A medical assessment;
- A recommendation about medication, treatment, or medical care;
- A legal opinion;
- A definitive read of any individual's character, capacity, or fitness for any role.
If you are making a clinical, medical, legal, employment, selection, or similar decision, you should obtain advice from a professional who is registered to provide that advice.
12. AI features
The member portal includes optional features that use the Anthropic Claude API to generate narrative summaries of profile data. These features:
- Are based on the same data you can already see in your portal account;
- Produce text that is reviewed by a practitioner before being shared with you (where the report-generation workflow is used);
- Are subject to the standard limitations of large language model output, including the possibility of phrasing that is occasionally imprecise or generic;
- Do not constitute advice or a substitute for direct human coaching conversation.
You may opt out of AI-assisted analysis on your profile at any time by emailing us. See the Privacy Policy for detail on how AI-feature data is handled.
13. Acceptable use
You must not, when using our website, portal, or any service:
- Use the service for any unlawful purpose;
- Attempt to gain unauthorised access to any part of the system, other users' accounts, or our underlying infrastructure;
- Probe, scan, or test the vulnerability of the service except through a coordinated responsible-disclosure conversation with us;
- Submit any content that is unlawful, defamatory, threatening, harassing, or that infringes any third party's rights;
- Use automated tools to scrape, mirror, harvest, or systematically download content from any part of the service;
- Misrepresent your identity, your role, or another person's identity in connection with the service;
- Attempt to interfere with the integrity, security, performance, or accessibility of the service for any user.
14. Termination
You may terminate your account at any time by emailing us. We will close your account and treat your data in accordance with the retention provisions of our Privacy Policy.
We may suspend or terminate your access immediately, without notice, if you breach these Terms, attempt to compromise the integrity of the service, or use the service in a way that creates legal risk for us or other users.
15. Governing law and jurisdiction
These Terms are governed by the laws of the State of South Australia and the Commonwealth of Australia. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of South Australia.
